3.1. What PolyCollect Is

PolyCollect provides:

• Market data analytics and visualization for prediction markets
• Outcome-level market analysis and insights
• Whale positioning insights and market activity indicators
• Automated activity detection indicators
• Market health metrics and informational market signals
• Educational content about prediction market activity
• Paper trading with simulated virtual balances for educational and practice purposes (does not involve real money, does not execute trades on any third-party platform, and does not reflect live execution prices, fees, or liquidity; results in paper trading have no bearing on real-world performance)
• Account features such as watchlist and saved preferences (data stored per our Privacy Policy)

PolyCollect is a data analytics and visualization platform. We do not execute trades, provide financial advice, recommend specific positions, hold funds, or facilitate betting activities.

3.2. What We Do NOT Do (Critical)

We do NOT:

• Store, hold, or custody user funds
• Process deposits, withdrawals, or payments
• Connect to or control user wallets
• Execute, settle, or facilitate trades
• Act as a broker, exchange, betting platform, or financial intermediary
• Provide financial, investment, legal, or trading advice
• Recommend buying, selling, entering, or exiting any position
• Guarantee profits, outcomes, or trading performance

All information displayed on PolyCollect is provided for informational and educational purposes only.

3.3. How PolyCollect Works

• You visit our website to view market data and analytics
• You make your own trading decisions based on the information provided
• Any trading you choose to do must be executed on third-party platforms
• PolyCollect is not involved in any transaction between you and third-party platforms
• Clicking through to Polymarket or any third-party platform is your choice; we do not control those platforms

3.4. Our Relationship with Third-Party Platforms

PolyCollect is not affiliated with, endorsed by, or responsible for Polymarket or any other third-party platform. We simply aggregate and display public data.

Any trading you choose to do must be executed on third-party platforms. PolyCollect is not involved in any transaction between you and third-party platforms.

Your relationship with any third-party platform is solely between you and that platform. You are responsible for reviewing and complying with their terms of service.

3.5. Notification and Alert Features

If you connect Telegram or other notification channels, you authorize us to send service messages to the identifiers you provide. Delivery of messages depends on third-party services (e.g., Telegram). We do not guarantee message delivery, timing, or accuracy. You may disconnect at any time.

4. Eligibility and Requirements

4.1. Age and Legal Capacity

You must:

• Be at least 18 years old
• Have full legal capacity to agree to these Terms
• Not be prohibited by law in your jurisdiction from accessing prediction market data

4.2. No Account Required for Basic Access

• Basic market data browsing does not require an account
• Certain features (watchlist, alerts, paper trading, saved preferences) require a free beta account using email signup
• No wallet connection, KYC, or financial information is ever required

4.3. User Responsibility for Third-Party Trading

If you choose to trade on Polymarket or any other platform based on PolyCollect's data, you are solely responsible for:

• Your account security on those platforms
• Your wallet and private key security
• All trades executed through your accounts
• Compliance with those platforms' terms of service

4.4. Email Security

If you sign up using email magic link authentication, you are responsible for the security of your email account. PolyCollect is not liable for unauthorized access to your account resulting from compromised email credentials.

5. Geographic Restrictions and Jurisdiction

5.1. Your Responsibility for Legal Compliance

You are solely responsible for determining whether accessing prediction market data and trading on third-party platforms is legal in your jurisdiction.

By using PolyCollect, you represent and warrant that you have independently researched all applicable laws in your country, state, or territory and that you are permitted to access prediction market data and related information in your jurisdiction.

5.2. No Legal Advice

• We do not provide legal advice
• We do not guarantee the legality of using prediction market platforms in your jurisdiction
• We do not track or verify user locations
• All legal risks associated with trading on third-party platforms are entirely yours

5.3. Restricted Jurisdictions

Third-party platforms such as Polymarket have their own geographic restrictions. You are responsible for reviewing their terms and ensuring you are permitted to use their services. PolyCollect takes no responsibility for your violation of any third-party platform's terms.

6. Third-Party Platforms and Data

6.1. Acknowledgment of Third-Party Terms

By using PolyCollect, you acknowledge that:

• You have read and understood the terms of service of any third-party platform you choose to use (including Polymarket)
• PolyCollect is not affiliated with, endorsed by, or responsible for any third-party platform
• We simply aggregate and display publicly available data from these platforms
• Any trades you execute are solely between you and the third-party platform

6.2. Disclaimer for Third Parties

PolyCollect uses data from third-party sources including but not limited to:

• Polymarket (prediction market)
• Public blockchain data

We do not control and are not responsible for:

• The accuracy, timeliness, or completeness of third-party data
• The availability, security, or operation of third-party platforms
• Any losses incurred from trading on third-party platforms
• Any changes to third-party platform terms or policies

7. Risks and Disclaimers

7.1. General Risk Warning

Prediction market trading involves significant financial risk, including the potential loss of your entire investment.

You should never trade with money you cannot afford to lose.

7.2. Data Accuracy Disclaimer

We do not guarantee the accuracy, completeness, reliability, or timeliness of any data displayed on PolyCollect.

Market data may be delayed, incomplete, unavailable, or contain errors due to third-party providers, APIs, blockchain networks, technical limitations, or other factors.

Whale tracking, automated activity indicators, market metrics, and other analytics are estimates based on available data and should not be interpreted as guarantees of future market movements or outcomes.

Past performance does not predict future results.

7.3. No Financial or Trading Advice

All information, analytics, indicators, summaries, and insights provided by PolyCollect are for informational and educational purposes only.

Nothing on PolyCollect constitutes financial advice, investment advice, trading advice, a recommendation, solicitation, or endorsement of any market position.

Users are solely responsible for their own decisions and should evaluate risks independently before using any third-party trading platform.

7.4. Platform Availability

We do not guarantee:

• Uninterrupted or error-free access to the platform
• That data will be available at all times
• That the platform will be free from viruses or other harmful components

8. Limitation of Liability

To the maximum extent permitted by applicable law, PolyCollect and its operators shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages, including loss of profits, trading losses, data loss, or other damages resulting from:

• Your use or inability to use the platform
• Any decisions made based on information displayed on PolyCollect
• Any errors, omissions, delays, or inaccuracies in data
• Any interruption or unavailability of the platform
• Any actions or failures of third-party platforms
• Any technical issues, security incidents, or external events

8.2. Third-Party Liability

We are not responsible for:

• The actions, errors, or omissions of Polymarket or any other third-party platform
• Losses incurred from trading on third-party platforms
• Technical failures of blockchain networks, smart contracts, or third-party APIs
• Changes to third-party platform terms or access restrictions

8.3. Maximum Liability

To the maximum extent permitted by law, PolyCollect's total liability arising from or related to your use of the platform shall not exceed the amount paid by you to use PolyCollect during the twelve (12) months preceding the event giving rise to the claim (or €0 if you have not paid us).

9. Your Responsibilities

You are solely responsible for:

• All trading decisions you make based on PolyCollect's data
• Any financial losses resulting from your trading activities
• Determining whether a particular trade or strategy is suitable for you

9.2. Legal Compliance

You are solely responsible for:

• Complying with all applicable laws in your jurisdiction
• Determining whether you are legally permitted to trade on prediction market platforms
• Paying any taxes associated with your trading activities

9.3. Account Security

If you create an account on PolyCollect (for beta features):

• You are responsible for maintaining the security of your email account
• You are responsible for all activity that occurs under your account
• You must notify us immediately of any unauthorized use of your account

10. Indemnification

You agree to defend, indemnify, and hold harmless PolyCollect, its operators, owners, directors, employees, and agents from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from or relating to:

• Your use of the platform
• Your violation of these Terms
• Your violation of any applicable law or third-party rights
• Your trading activities on third-party platforms
• Your use of any third-party platform (including Polymarket)

This indemnification obligation survives your termination of use of the platform.

11. Intellectual Property

11.1. Our Property

All rights, title, and interest in the PolyCollect platform, including design, code, logos, and content, belong to us or our licensors. You may not copy, modify, or reproduce our intellectual property without our written consent.

11.2. Your Data

You retain all rights to any information you submit to PolyCollect (e.g., email address for beta access). We will not sell or share your data except as described in our Privacy Policy.

12. Prohibited Activities

You may not:

• Use the platform for illegal activities
• Attempt to hack, disrupt, or compromise platform security
• Use automated systems (bots, scrapers) to access the platform without authorization
• Use the platform to harass, abuse, or harm others
• Impersonate any person or entity
• Violate any applicable laws or regulations

13. Suspension and Termination

13.1. Our Rights

We may suspend or terminate your access to the platform at any time, for any reason, including:

• Violation of these Terms
• Suspected illegal or fraudulent activity
• Request by law enforcement
• Any other reason at our sole discretion

13.2. Your Rights

You may stop using PolyCollect at any time. No funds are held on PolyCollect, so termination does not affect any assets you may have on third-party platforms.

14. Dispute Resolution

14.1. Governing Law

These Terms shall be governed by and construed in accordance with the laws applicable to PolyCollect's jurisdiction of operation, excluding its conflict of law provisions.

14.2. Arbitration

Any dispute arising from these Terms or your use of the platform shall be resolved through binding arbitration, not in court. You waive the right to a jury trial and the right to participate in class-action litigation.

14.3. Class Action Waiver

You agree that any claims shall be brought solely in your individual capacity, not as a plaintiff or class member in any purported class or representative proceeding.

15. Changes to Terms

We may modify these Terms from time to time. Material changes will be notified by:

Your continued use of the platform after changes constitutes your acceptance of the new Terms.
